Los presentes Términos y Condiciones regulan el uso de la plataforma tecnológica denominada comercialmente "QuHealthy", la cual es propiedad y es operada legalmente por Marcos Sandoval Ruiz, quien es una persona física con actividad empresarial debidamente registrada ante las autoridades fiscales de México.
Welcome to QuHealthy. These Terms and Conditions govern the access and use of the QuHealthy web and mobile platform, legally operated by Marcos Sandoval Ruiz, a natural person with business activity registered under the laws of the United Mexican States.
By accessing, browsing, registering, or using QuHealthy (hereinafter, the 'Platform'), whether as a Patient ('User') or Healthcare Provider ('Professional'), you expressly agree to be legally bound by these Terms and Conditions and our Privacy Notice unconditionally. QuHealthy reserves the strict right to modify, update, or amend these Terms at any time, unilaterally, notifying through the Platform. Continued use after such modifications constitutes your undeniable acceptance.
QuHealthy acts EXCLUSIVELY as a technological and commercial intermediary that provides software infrastructure to connect Users with pre-verified Healthcare Professionals. QUHEALTHY DOES NOT PROVIDE MEDICAL, PSYCHIATRIC, DIAGNOSTIC, TREATMENT, OR DISEASE PREVENTION ADVICE. Any content issued on the Platform does not substitute a doctor's advice. Every doctor-patient relationship, diagnoses, and prescriptions issued are the absolute and exclusive legal and clinical responsibility of the Professionals. In case of a medical emergency, call 911 immediately or go to the nearest hospital; our platform is not designed for emergencies.
To use the Platform, the User must be of legal age (18 years in Mexico) with full legal capacity. You agree to provide reliable, complete, recent, and accurate information. You are exclusively responsible for maintaining the confidentiality of your account and password; any transaction or action under your account will be deemed your own and valid. QuHealthy reserves the right to revoke access to accounts with fraudulent behavior or moral and legal breach to these terms.
Every Healthcare Professional ('Professional') registered on QuHealthy is legally obliged to comply with current Mexican health regulations imposed by COFEPRIS, the General Health Law, and competent bodies. Professionals declare and guarantee under perjury penalty that they have a valid professional degree, professional license (cedula) registered with the National Registry of Professionals (SEP), and any corresponding permit or certification. QuHealthy executes periodic reviews (KYC) but is not a perpetual guarantor of such credentials; any act or omission derived from the service falls civilly and criminally on the medical expert.
Using the calendar generates an Appointment intention, validated by a fee set independently by the Professional. QuHealthy uses secure third-party payment technology (e.g., Stripe). You agree that the Platform makes the respective transactional charge to your authorized and valid payment method. General Cancellation Policies: (a) User cancellations with +24 hrs: Full refund applicable. (b) User cancellations / 'No-shows' with -24 hrs: The Professional has the right to retain 100% or a percentage defined in their policies, without QuHealthy intervening in monetary mediations beyond the initial credit. (c) Professional Cancellations: Full refund guaranteed or free rescheduling. Accounting invoices for the provision of medical services are issued directly by the Professional, not by QuHealthy.
When using QuHealthy and its teleconsultation and video call tools, it is strictly prohibited to: (1) Upload in bad faith, illicit, defamatory material, viruses or software interruptions; (2) Infringe the bases of the electronic clinical record regulations (NOM-024-SSA3-2012); (3) Record, broadcast or perform acts without prior express and formal consent; (4) Impersonate clinical identity. Any transgressor will be reported to the corresponding penal jurisdiction, in addition to the immediate cancellation of their portal privileges.
All inherent rights, trademarks, patents, logos, data compilations, visual interfaces, underlying code (source-code) and algorithms present in QuHealthy belong exclusively to Marcos Sandoval Ruiz. You receive only a limited, non-transferable, and essential license to use the software at the client/user level; reverse engineering, copying, subleasing, data mining, or systematic extractions are impossible.
Occasionally, QuHealthy links or hosts software and modules provided by third-party companies (laboratories, pharmaceuticals, credit card processors). We disclaim all liability for the content, technical interruption, or security issues of external providers.
TO THE MAXIMUM EXTENT PERMITTED BY FEDERAL LAW AND JURISPRUDENCE, IN NO EVENT AND UNDER NO LEGAL THEORY WILL QUHEALTHY AND ITS OPERATORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING MEDICAL NEGLIGENCE, PHYSICAL INJURY, LOSS OF PROFIT, AND DATA LOSS. As a user and healthcare professional, you agree to defend, indemnify, and hold the Platform completely harmless against complaints resulting from the misuse of its portal.
For the validation, execution, compliance, and material interpretation of these guidelines, the express will to regulate it under the Commerce Code, Federal Civil Code of Mexico, and the General Health Law is stacked, and to resolve contingencies or user lawsuits, the parties designate exclusively the courts of Mexico City, discarding jurisdiction that, due to subsequent or parallel domicile, assigns them. Before initiating legal contingencies, the User agrees to exhaust conciliatory means through customer service portals for a period of no less than 30 days, and otherwise conciliate with competent decentralized bodies such as PROFECO or CONAMED.
